各省、自治区、直辖市及计划单列市劳动(劳动人事)厅(局):
自1987年原劳动人事部、公安部联合颁发《关于未取得居留证件的外国人和来中国留学的外国人在中国就业的若干规定》(劳人培〔1987〕22号,以下简称《规定》)以来,各地根据文件精神,着手开展了这项工作,并取得了一定的成效。但目前仍存在不少问题,工作很不
平衡,在一些地区外国人就业处于失控状态。为进一步做好外国人在华就业的管理工作,现对有关问题通知如下:
一、各地要按照劳人培〔1987〕22号文件的规定,对外国人在华就业管理工作进行一次检查,掌握外国人在当地就业的情况(包括就业人数、其中持各种签证的人数、聘雇单位、聘雇原因等),分析研究管理工作的现状和存在的问题。同时,积极向聘雇外国人的单位宣传《规定
》内容,做好管理工作。
二、尚未开展这项工作的地区,要按照《劳动部关于做好外国人在中国就业管理工和几个问题的通知》(劳字〔1988〕43号)规定,尽快确定相应管理机构,并指定专人负责,于年内限期对未取得居留证件的已就业的外国人进行登记和审查,并为符合条件者补办手续,对不符合
条件者按规定进行处理。
三、在对外国人签发就业证时,一定要按照劳人培〔1987〕22号文件规定的条件从严掌握,受聘雇者将要从事的工作必须是聘请单位有特殊需要,非外国人不能从事的工作,对一般求职者,要严格加以控制。
四、请于10月底前将外国人就业的情况(包括办证人数、各类人员数量、开展工作的主要做法、存在的问题和建议)报部劳动力管理和就业司。

PART II PROTECTION OF WAGES ON INSOLVENCY FUND BOARD

There is hereby established a board to be known as the Protection
of

Review by Board
Any applicant aggrieved by any decision of the Commissioner
under
ion 16 may in writing--
request the Commissioner to give reasons for that decision; and
after being given reasons under paragraph (a),
request the
issioner to refer the application to the Board.
Upon receiving a request from an applicant under subsection (1)
(b),
Commissioner shall forward all documents relating to the
application

The Board may confirm or vary any decision of the Commissioner

Additional power of Commissioner
Notwithstanding that in any particular case a petition referred
to in
ion 16 (1) (a) (i) or (b) has not been presented against an
employer,
Commissioner may, subject to subsection (2) of that section,
make an
ratia payment under that section in that case if in his opinion--

天津市专业技术人员和管理人员继续教育条例

第一条 为不断提高专业技术人员和管理人员的专业技术水平和管理水平,促进经济和社会发展,根据国家有关法律、法规,结合我市实际情况,制定本条例。
第二条 本条例所称专业技术人员和管理人员继续教育(以下简称继续教育),是指对专业技术人员和管理人员进行的以更新、补充、拓展知识,增强创新能力,提高专业技术和管理水平,促进企业、事业单位发展为目的的教育。
专业技术人员和管理人员有依法接受继续教育的权利和义务。
第三条 在本市企业、事业单位专业技术岗位和管理岗位工作的人员的继续教育,适用本条例。
第四条 继续教育要以科学的理论为指导,面向现代化、面向世界、面向未来,坚持按需施教、学以致用、讲求实效和创新提高的原则。
第五条 各级人民政府应当根据经济、科技和社会发展的需要,编制继续教育中、长期规划,逐年加大投入,支持和引导企业、事业单位自主实施继续教育,鼓励专业技术人员和管理人员自觉参加继续教育。
第六条 人事行政部门是本市继续教育的主管部门,负责继续教育工作的组织、指导、协调和管理监督工作。
教育、经济、科技、卫生、劳动、财政、物价等部门应当按照各自职责做好继续教育以及相关工作。
行业主管部门和行业组织具体负责本行业继续教育的规划、指导和推动工作。
第七条 继续教育的内容应当根据企业、事业单位的发展和专业技术人员、管理人员提高自身素质的需要确定,进行先进的理论、知识、技术和技能的学习。
第八条 企业、事业单位应当根据本单位的实际和需要,制定继续教育计划并负责组织实施。
第九条 专业技术人员和管理人员接受继续教育,以参加本单位、本行业组织的学习和有计划、有考核的自学活动为主,也可以根据单位的需要和可能通过以下形式进行:
(一)参加进修班、培训班和研修班;
(二)到教学、科研、生产单位进修;
(三)参加国内外学术会议和学术讲座;
(四)出国、出境进修、考察、培训;
(五)通过公众传播媒体和互联网接受远程教育;
(六)参加其他形式的继续教育活动。
第十条 专业技术人员和管理人员脱产、半脱产接受继续教育的时间,每人每年累计不得少于十二天;具有高级专业技术职称和从事高新技术工作的专业技术人员脱产、半脱产接受继续教育的时间,每人每年累计不得少于十八天。接受继续教育的时间,可以集中使用,也可以分散使用。
专业技术人员和管理人员脱产、半脱产接受继续教育期间,工资福利待遇不变。单位与个人另有约定的除外。
鼓励企业、事业单位增加安排专业技术人员和管理人员接受继续教育的时间。倡导专业技术人员和管理人员在完成本单位安排的继续教育任务之外,利用业余时间参加继续教育。
第十一条 经营困难的单位,根据本单位的实际情况确定相应的继续教育办法,要利用停产、半停产或者转产的空余时间,组织专业技术人员和管理人员开展继续教育。
第十二条 继续教育费用由国家、单位和个人多种渠道解决。
市和区、县人民政府应当将继续教育管理工作经费列入本级政府财政预算。
企业、事业单位应当保证继续教育所需经费不低于国家规定的标准,其费用从职工教育经费中列支。开发新技术、研制新产品和进行课题研究的继续教育费用,可以在管理费用和项目资金中安排。
企业、事业单位可以根据国家有关规定接受社会组织和个人对继续教育事业的捐助。
第十三条 市人事行政部门应当根据需要,确定通用知识、技能等继续教育的公共科目,制定计划并组织、协调有关部门实施。
市行业主管部门和行业组织应当根据行业的发展趋势,确定继续教育导向性内容,编写继续教育科目指南,组织继续教育示范活动,指导本行业的继续教育工作。
第十四条 继续教育的师资可以聘请具有较高理论水平、实践经验丰富的专家和具有高中级专业技术职称的人员担任,坚持专、兼职相结合以兼职为主的原则。
第十五条 高等院校和取得办学资格的科研院所、社会团体、大中型企业的培训机构及其他办学单位,是实施继续教育的重要基地,可以发挥自身优势,按照国家和本市有关规定,面向社会开展相关专业的继续教育活动。
办学单位开展继续教育活动时,应当保证教学质量,并接受有关部门的指导和监督。
第十六条 专业技术人员和管理人员应当遵守国家和本市有关继续教育的规定,遵守所在单位的继续教育管理制度,服从单位安排。接受继续教育后,有义务为本单位更好地服务。
第十七条 专业技术人员和管理人员接受继续教育的权利受到侵害时,可以向所在单位的上级主管部门提出申诉;无主管部门的单位可以向所在区、县人事行政部门提出申诉。接受申诉的部门应当在收到申诉书之日起三十日内作出处理决定,并答复本人。
第十八条 企业、事业单位可以根据需要,同在国内连续脱产接受继续教育学习半年以上、半脱产学习一年以上,以及被派出国、出境进修、培训的专业技术人员和管理人员,就接受继续教育后为本单位服务的年限和违约责任等事项签订书面协议。
因履行协议发生争议的,分别按照劳动争议和人事争议的有关规定解决。
第十九条 本市实行继续教育登记制度。专业技术人员和管理人员的所在单位应当将其学习情况和考核结果在继续教育证书上登记。
继续教育证书应当连续记载专业技术人员和管理人员接受继续教育的情况,并将其作为考核专业技术人员和管理人员的主要内容和聘任、晋升职务的重要依据之一。
第二十条 市和区、县人民政府,行业主管部门和行业组织,应当对在继续教育工作中做出显著成绩的单位和个人进行表彰和奖励。
第二十一条 企业、事业单位有下列情形之一的,由市或者区、县人事行政部门批评教育、责令限期改正:
(一)未按规定组织实施继续教育的;
(二)未按规定保证专业技术人员和管理人员接受继续教育时间的;
(三)未按规定保证专业技术人员和管理人员在脱产、半脱产接受继续教育期间的工资福利待遇的;
(四)未按规定提供继续教育经费的;
(五)未按规定对专业技术人员和管理人员接受继续教育情况进行考核、登记的。
第二十二条 专业技术人员和管理人员有下列情形之一的,其所在单位可以根据不同情节,分别给予批评教育,追偿继续教育费用,并按国家和本市有关规定,扣发脱产、半脱产学习期间的工资;情节严重的,可以缓聘、解聘其专业技术职务或者管理职务:
(一)无正当理由不服从本单位继续教育安排的;
(二)未经单位批准,无正当理由擅自中止学习的;
(三)学习期间违反办学单位的有关规定和制度,造成不良影响的;
(四)未达到学习目标的要求,修业不合格的。
第二十三条 行政机关工作人员在继续教育工作中侵害企业、事业单位和专业技术人员、管理人员合法权益的,由其所在单位或者上级主管部门按照有关规定给予行政处分。
第二十四条 本条例自2002年2月1日起施行。1989年10月11日天津市第十一届人民代表大会常务委员会第十一次会议通过的《天津市专业技术人员继续教育规定》同时废止。
